Mediation is a chance for the formation of a new legal culture in Ukraine!

This was emphasized by the People’s Deputy of Ukraine Yuri Miroshnнchenko in a live broadcast of the program “Pro Parliament” of the parliamentary TV channel “Rada”.

“Mediation is an out-of-court settlement of a conflict on a voluntary basis, in which the two sides agree to the communication organized by the mediator, a mediator who should be a neutral and uninterested person. The work of the mediator is to find points of equilibrium, where the interests of each of the parties should be maximally secured – this contributes to the voluntary adoption of the decision by both parties “, – explains the parliamentarian.

Yuriy Miroshnychenko observes that, due to the burdens of the Ukrainian judicial system, mediation is necessary in a modern society. In many countries in Europe and in the world, it is already a mandatory stage of pre-trial detention: “Mediation saves time, because it can deal with family, civil and business outside the court. Consideration of the latter in mediation is very useful for the economy, because judicial decisions in this area, unfortunately, are often delayed for years. In addition, it is very important that mediation ensures the confidentiality of the process. ”

Yuri Miroshnychenko, a lawyer with a specialization in constitutional law, emphasizes that the clear legal status of mediation in the legal system of Ukraine is necessary: ​​”We must learn to negotiate, to compromise, and to unite for the sake of the goals that society needs”
